Serakki Terms of Service

Version: 2026-10-22.2

Applies when presented and accepted as described below. Publishing this document does not establish acceptance or replace an agreement you have already accepted.

A Serakki purchase licenses the desktop game, its included Studio and the content stated in its offer. Browser play, cloud saves and hosted Studio storage, where offered, supplement that license without an additional charge and are subject to resource limits, suspension and service-closure conditions. Hosting without an additional fee does not make paid content free. Mini itself is free; its browser hosting is also supplementary. The Playtest Terms cover free access to the complete product during the announced playtest and continued use of obtained desktop playtest builds afterwards. Your original content remains yours. Mandatory rights and express purchase commitments remain binding.

1. Who provides the service

These terms are between you and Marek Hanzal, a self-employed individual (sole trader) registered in the Czech Trade Licensing Register (živnostenský rejstřík), business identification number (IČO) 87911418, VAT identification number (DIČ) CZ9012100042, with a registered business address at Severní 1175, 363 01 Ostrov, Czechia. In these terms, "I", "me" and "my" refer to the service provider. Contact for service enquiries, statutory complaints and legal requests: support@serakki.dev.

The "Service" means the hosted Serakki account and applications: Serakki Hub, Game and Studio at serakki.dev, together with their supporting hosted functions. Hub provides your account dashboard and access to available products; Game runs compatible Serapacks; Studio provides browser-based world authoring within its offered features.

The End User License Agreement ("EULA") governs the software and content permissions it grants. These terms govern hosted access, accounts and service operation. Applicable purchase terms determine the product, price, duration and entitlements you obtain. They do not cancel an entitlement already granted under another agreement. Mandatory law takes priority over conflicting wording in any of these documents.

For browser software and content, the applicable EULA forms part of this Service agreement and is linked above for you to read before acceptance. Accepting these terms does not, by itself, replace an agreement governing a desktop copy you already obtained.

2. Creating an account and accepting these terms

Account-based access requires registration, verification of your email address and an explicit acceptance step linking to the version of these terms that applies to you. I record the account and acceptance time. Merely visiting a website, receiving a sign-in email or opening this document does not constitute acceptance. The Privacy Policy explains personal-data processing; it is information, not a request for blanket consent.

For participation in the announced desktop and cloud playtest, the Playtest Terms form part of the agreement presented for acceptance. They explain free access to the complete product, breaking updates during testing, the hard reset of playtest accounts and hosted data at the transition to Early Access, and continued use of obtained desktop playtest builds without further voluntary support. They do not retrospectively replace an existing agreement merely because a notice or a new document is published.

To register a Serakki account, you must be at least 18 years old and legally able to enter this agreement. Registration requires your declaration that you are at least 18; this is not independent age verification. This account requirement is separate from the age suitability of individual Serapacks and the permissions for offline desktop use under the EULA.

Provide an email address you control and keep the information needed to operate your account accurate. Protect access to your mailbox and one-time sign-in codes, and contact support@serakki.dev if you suspect unauthorized access. Do not share, sell or transfer your account or another person's credentials except where an applicable agreement or mandatory law permits it.

You are responsible for your own use and for people you authorize to act through your account. This does not make you automatically responsible for unauthorized activity outside your reasonable control or remove my security obligations. An agent acting on your behalf receives no permissions beyond your own.

3. Software licenses and supplementary hosted access

Creating and maintaining an account is free. The browser Game has no separate access fee. Access to a particular Serapack depends on that Serapack's offered terms and your entitlement:

  • Mini is a free Serapack.
  • The full Serakki world requires its own valid license.
  • Other official Serapacks or DLC may be free or require separate licenses, as stated in their offers.
  • Studio is included with Serakki and is not sold separately. Browser access requires the corresponding Studio entitlement on your account; owning a different Serapack does not, by itself, grant Studio access.

A base Serakki purchase licenses the full desktop Game, its included Studio and the acquired game content. Where offered, browser play, cloud saves and hosted Studio storage are optional supplementary functions provided without an additional charge. There is no separate cloud subscription or automatic recurring charge. The same content license is required whether you use the content in the browser or on desktop; hosting without an additional fee does not turn a paid Serapack into free content.

Supplementary hosting is subject to the reasonable resource limits and restrictions below, and may be discontinued under section 10. It is not a promise of unlimited storage, processing or transfer, or hosted operation for the duration of a software license. Mini is free in its own right, including its desktop edition; its browser hosting has the same supplementary status. These distinctions do not exclude mandatory consumer rights or override a hosted commitment expressly included in an accepted offer.

During the announced playtest, the Playtest Terms grant permission to use Mini, the full Serakki game and its world, and Studio, on desktop and in the cloud without a purchase. This specific grant supplies the required playtest permissions. Cloud playtest access ends with the playtest; obtained desktop playtest builds may be kept and used afterwards, without further voluntary support, under the EULA and Playtest Terms.

A Serapack is a playable world package, not the Game application or an asset library. Free access, account registration or possession of a package does not grant rights to other paid content or to reuse protected resources. Community authors retain the rights they hold in their content; the EULA's community-content rules continue to apply.

Licenses apply to the product and scope stated in the applicable offer. A license may be permanent or time-limited; validity does not, by itself, mean a subscription. A permanent license does not expire merely because time passes, but its scope and the separate conditions for hosted access still apply. No automatic renewal or recurring charge arises solely from accepting these terms. Any subscription must be separately and expressly agreed, with its price, term, renewal and cancellation conditions disclosed beforehand.

A Steam or other store purchase grants hosted access only if that access is expressly included and the entitlement can be verified through an offered linking or redemption process. These terms do not promise that such an integration is available. Browser access requirements do not remove a Studio entitlement already included with a lawfully obtained desktop edition.

4. License checks and loss of access

The Service checks your account and the relevant license before allowing protected access. Do not bypass those checks, impersonate another account, forge purchase evidence or use another person's entitlement. If a recorded entitlement appears incorrect, contact support@serakki.dev for review; a failed technical check does not, by itself, establish that your lawful license has ended.

Expiry of a time-limited license, a valid withdrawal, or lawful termination may end access to the affected product. A successful partial refund, including a price reduction that leaves the purchase in force, does not by itself end the license or access granted by that purchase. A pending or failed refund has no such effect. A successful full refund that cancels the affected purchase ends the rights granted solely by that purchase, subject to mandatory law and any independent license or other valid purchase. That does not, by itself, end your account, remove unrelated licenses or transfer rights in your original content to me. Account and privacy requests remain available by email even if you cannot sign in or use a licensed product.

A payment dispute or chargeback decision, including a dispute recorded as lost, does not by itself revoke the license or access granted by a purchase. Any separate termination requires an applicable contractual or legal basis. Exercising statutory complaint or remedy rights is not, by itself, abuse.

Ending access and deleting stored content are separate matters. Storage and retention follow section 10 and the Privacy Policy; these terms do not promise indefinite cloud storage after access ends. Statutory rights to retrieve content or obtain a refund remain available.

5. Your projects, saves and other content

You retain the rights you hold in your original projects, artwork, audio, text and other content. Uploading, editing or storing it in Studio does not transfer ownership to me. You must have the rights needed for the material you supply and for the uses you request.

You grant me a limited, non-exclusive permission to store, reproduce, back up, technically process and transmit that content only as necessary to provide the requested Service, maintain its security and investigate technical failures. This includes using the hosting and storage providers described in the Privacy Policy. It does not authorize selling your content, using it in advertising or publishing a private project to other players without your instruction. Copies retained after deletion may be used only for the lawful backup, security or legal-retention purposes described in that policy.

Sharing, publication, export and import are available only where the Service expressly offers them. A private project does not become a public Serapack merely because you create or store it. Where you choose to share content, its recipients may retain copies under the permissions you grant; deleting your account cannot recall those copies.

Official Serakki resources remain protected under the EULA. A Studio entitlement permits use of the authoring tools within the licensed edition's scope; it does not grant permission to extract or reuse official artwork, audio or world configuration. The EULA's rules for community Serapacks, screenshots, videos and streams also apply to relevant Service use. Separate third-party licenses and mandatory rights remain unaffected.

6. Acceptable use

Use the Service lawfully and within the permissions granted to your account. In particular, do not:

  • Access, change or disclose another user's private data without authorization.
  • Upload material you have no right to use, unlawful content or malicious code.
  • Attack, overload or deliberately disrupt the Service, or evade its technical usage limits.
  • Use hosted storage or delivery as general-purpose file hosting, a public download mirror or a transfer service unrelated to your permitted Serakki use.
  • Use multiple accounts, automated requests or repeated bulk transfers to evade restrictions or create a manifestly disproportionate load on storage, processing or bandwidth.
  • Circumvent authentication, license checks or product restrictions, except where mandatory law expressly permits an activity.
  • Use the Service to redistribute protected applications or assets, or sell or monetize community Serapacks or access to them contrary to the EULA.

These restrictions do not prohibit lawful inspection, interoperability work, supported authoring or other rights preserved by the EULA or mandatory law. Report suspected security problems or unlawful content to support@serakki.dev; do not expose other users' data to demonstrate a problem.

Hosted functions may have reasonable technical limits on requests, storage, uploads and transfers to protect availability, security and operating costs. Material limits must be explained before the affected use or purchase, and later changes follow section 7. Normal gameplay, supported Studio authoring and permitted agents are not abuse merely because they use resources or automation. A resource limit can still apply to legitimate activity; an immediate protective restriction follows section 9.

7. Features, availability and changes

The Service provides the features actually offered for the relevant product and edition. Browser and desktop capabilities can differ. A feature shown in development, a planned integration or a preview is not a commitment to deliver it, include it in an existing purchase or meet a release date. Any express commitments made in your purchase remain binding.

Hosted use requires a compatible browser and an internet connection. Applicable system requirements, storage limits and material product restrictions must be disclosed before you commit to an offer. I do not promise uninterrupted availability or a service-level agreement unless expressly included in that offer. This does not exclude necessary updates, conformity obligations or remedies required by law.

I may maintain and update the Service for security, defect correction, legal compliance, compatibility with its technical environment, or improvements to the offered functionality. Changes beyond those necessary to maintain conformity must have a valid reason permitted by the agreement and law, be made without additional cost where required, and be explained in clear notice. If a change negatively affects your access or use beyond a minor extent, I will provide the advance information, notice in a durable medium and termination or other remedies required by applicable law. The right to make changes is not an unrestricted right to withdraw paid access or materially reduce a purchased product.

8. Purchases and consumer rights

Creating an account or accepting these terms does not place a paid order. Before any paid offer is accepted, the seller must identify itself and disclose the product, total price, duration, material functionality and compatibility requirements, payment and delivery conditions, and applicable renewal, cancellation, complaint and withdrawal information. You are charged only through a separately agreed purchase.

Consumers retain all applicable rights concerning supply, conformity, necessary updates, remedies for defects, price reductions, refunds and withdrawal. Where a 14-day withdrawal period applies, these terms do not waive it. Any request to begin performance early, and any acknowledgment concerning loss of withdrawal rights for digital content, must be obtained separately where the law requires it. The rules for digital content and ongoing digital services can differ; account registration is not such a request or acknowledgment.

For a purchase from a third-party store, that seller's purchase and refund process applies to the store relationship. This does not remove obligations I owe you directly. Contact support@serakki.dev for statutory complaints about my Service; Discord is optional. I will handle statutory complaints within the applicable legal deadlines and provide the required confirmation and outcome information. A statutory complaint is not discretionary support or ordinary feedback.

9. Restriction and suspension

I may restrict the affected hosted functions or suspend an account where reasonably necessary to address a material breach of these terms, suspected account compromise, unlawful content, a serious security risk or a legal obligation. I may act immediately, before contacting you, where there are reasonable grounds to believe that activity is causing or threatens serious disruption, unauthorized access, or substantial avoidable infrastructure costs. This includes suspected abuse of requests, storage or transfers. A protective suspension allows investigation; it does not, by itself, establish that you deliberately breached these terms.

Restrictions must be proportionate in scope and duration. I will explain the reason and how to request review as soon as reasonably practicable, unless disclosure is legally prohibited or would materially compromise security or the investigation. Where practicable and lawful, I will give you a reasonable opportunity to remedy a breach that can be remedied before permanently terminating hosted access. I will review a protective restriction and lift it when its grounds no longer justify it, unless another lawful basis for restriction applies.

You may contact support@serakki.dev to contest a restriction, correct mistaken account or license information, or exercise your legal rights. I will review the relevant circumstances. Suspension does not authorize confiscating your original content, revoking an unrelated store account or refusing remedies required by law.

A hosted restriction does not, by itself, cancel a separate lawful desktop license. An account suspension may block ordinary download and export controls; contact support@serakki.dev to exercise any surviving download or content-retrieval rights. I may provide a secure alternative without restoring unrestricted hosted access. Data retention and deletion remain separate from suspension and follow section 10 and the Privacy Policy.

10. Closing an account, service closure and stored data

You may request account closure at support@serakki.dev, or through an account control where one is offered. I may need proportionate verification to protect your account. Before requesting closure, retrieve content you want to keep through any available export function or contact me about applicable retrieval rights. Closing an account ends its hosted access and can prevent use of account-linked products; it does not, by itself, waive a refund claim or terminate a separate desktop license.

I may discontinue supplementary hosted functions for technical, security, legal or financial-viability reasons. Outside the announced playtest, I will give reasonable advance notice before a planned permanent closure of the Service or a material hosted product, explain the effect on access and stored content, and provide a reasonable opportunity to retrieve content where applicable. A legal prohibition or urgent security issue may prevent advance notice. Any outstanding paid commitments, required refunds and statutory retrieval rights must still be addressed. A permanent software or content license is not a guarantee that cloud infrastructure will run forever, and this clause does not cancel a hosted duration expressly promised at purchase.

For such a planned closure outside the playtest, where your desktop license remains valid, I will provide a reasonable opportunity to obtain the desktop edition and licensed content covered by your purchase and retrieve your stored content, through available functions or an appropriate support arrangement. Closure does not, by itself, end your right to use lawfully obtained desktop copies. It does not grant new content or promise that cloud data will work with a different software version or runtime.

Account data, projects and saves are retained and deleted according to the purposes and criteria in the Privacy Policy. Data no longer needed for the Service is deleted, subject to lawful backup, security, record-keeping and legal-claim needs. Neither account closure nor license expiry guarantees immediate erasure from every provider backup. I do not take ownership of your content when access ends. Where the law requires me to make content available after termination, I will do so without charge, within a reasonable period and in the required commonly used, machine-readable format.

For the announced playtest, the Playtest Terms govern temporary storage, breaking updates and the hard reset. There is no contractual promise of playtest data preservation, migration, restoration, export or compatibility between versions. Statutory rights remain unaffected.

11. Privacy and communications

The Privacy Policy explains account information, sessions, hosted content, technical diagnostics, recipients, retention and your rights. The Service uses the technical storage necessary to provide sign-in and requested functions. It does not treat acceptance of these terms as consent to advertising, optional tracking or unrelated uses of your data.

I may send messages needed to verify and secure your account, provide requested access, handle complaints and explain material service or contractual changes. These service messages are separate from marketing. No marketing subscription is created by accepting these terms.

12. Liability and support

Voluntary help is available at my discretion unless expressly included in an offer. There is no additional promise of a response time, resolution or particular fix. To the extent law permits and except for express commitments, the Service is provided "as available" without additional contractual warranties. These limits do not remove required support, necessary updates or mandatory consumer remedies, including where the law protects users of free digital services.

Only to the extent applicable law allows, I exclude liability for indirect or consequential losses, including loss of profit or business opportunity. I do not exclude liability for death or personal injury, fraud, intentional misconduct, gross negligence, breach of mandatory consumer obligations, or other liability that cannot lawfully be excluded. Mandatory rights and express contractual commitments take priority over conflicting wording here.

13. Changes to these terms

The version presented to you and accepted governs your Service agreement. Publishing a new version does not, by itself, replace it. Material proposed changes will be brought to your attention in advance, with their effect and intended effective date, and an explicit acceptance step where required. A change requiring agreement does not become accepted merely because you remain silent or continue to hold an account.

If you do not accept proposed terms, I will explain the lawful options for continuing under the existing agreement or ending the affected Service, including the effect on paid access, stored content and any required remedies. Changes cannot retroactively remove acquired rights or override mandatory law. Privacy-notice updates inform you about processing; they do not create consent to a new optional purpose.

14. Governing law and disputes

These terms are governed by the laws of the Czech Republic. If you are a consumer, this choice does not deprive you of mandatory protections under the law that would otherwise apply, including protections in your country of habitual residence. Disputes may be brought before any court competent under applicable law. These terms do not require mandatory arbitration or waive access to courts.

For eligible consumer disputes with me arising from a purchase or paid service that remain unresolved after you contact me, you may seek out-of-court resolution through the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI), Gorazdova 1969/24, 120 00 Praha 2, Czechia. Information and the submission process are available at ČOI: consumer dispute resolution. For disputes with a store as the seller, use the process applicable to that seller. Your right to go to court remains unaffected.

If a provision is unlawful or unenforceable, it applies only to the extent legally permitted or is disregarded as the law requires. The remaining provisions continue only insofar as they can lawfully do so. An invalid restriction does not remove the statutory right it attempted to restrict.
