# Serakki End User License Agreement

<!-- @PLAYTEST Review phase access and desktop-build support clauses at closure; preserve rights already granted. -->

Version: 2026-10-22.2

Applies from the Software's first public distribution, subject to the acceptance requirements below.

> This agreement covers official copies of Serakki Mini, the full Serakki game, its included Studio, and any updates or DLC you lawfully obtain. Mini is free and has no voluntary technical support. The full game offers discretionary help by email and Discord. You may study the software and publish or monetize gameplay videos and streams, including the game's audio. Community Serapacks belong to their authors and may be shared privately or publicly under section 6, which prohibits selling or monetizing access to community Serapacks. A Serapack is a playable world, not an asset library; its author controls permissions for their own resources. You may not alter or redistribute official builds or distribute standalone protected assets except where this agreement or mandatory law permits it.

## 1. Parties and scope

This agreement is between you and Marek Hanzal, a self-employed individual (sole trader) registered in the Czech Trade Licensing Register (živnostenský rejstřík), business identification number (IČO) 87911418, VAT identification number (DIČ) CZ9012100042, with a registered business address at Severní 1175, 363 01 Ostrov, Czechia (the "Licensor"). In this agreement, "I", "me" and "my" refer to the Licensor. Contact for support, statutory complaints and legal requests: support@serakki.dev.

"Software" means the official Serakki applications and their bundled game content, documentation, updates and separately obtained DLC. It does not include independently owned third-party components or user-created content except to the extent stated below.

The desktop full Serakki game and paid DLC require a valid entitlement from me, Steam or another distributor expressly authorized by me. A base Serakki purchase licenses the full desktop Game, its included Studio and the game content stated in its offer. This agreement does not grant access to the desktop full game, its Studio or paid content merely because you downloaded Mini. It does not promise future features, DLC or release dates, or include separately priced DLC in a base-game purchase.

During the announced playtest, I grant free use of the complete current Serakki product under the [Playtest Terms](https://serakki.dev/legal/playtest): Mini, the full Serakki game and its world, and Studio, including their desktop and cloud features. No purchase is required for that playtest permission. The Playtest Terms form part of the playtest agreement when supplied and accepted with this EULA.

You may keep and continue using official desktop playtest builds you lawfully obtained under this agreement, including the full game and its Studio. That permission does not expire merely because the playtest ends. Voluntary support for those builds ends with the playtest as described in section 8. This permission does not include continued cloud access or a right to new builds, updates, Early Access or the final release. Mini and any separately obtained license retain their own terms.

The hosted Hub, Game and Studio applications are also subject to the [Terms of Service](https://serakki.dev/legal/terms), which govern accounts and hosted access. Where offered, browser play, cloud saves and hosted Studio storage are supplementary functions provided without an additional charge. A software license does not promise unlimited hosted resources or cloud operation for the duration of that license. Hosted functions may be limited, suspended or discontinued under the Terms of Service, subject to express commitments and mandatory law.

A Serakki account is free. Individual Serapacks retain their own access terms in either runtime: Mini is free; the full Serakki world and other paid content require the relevant valid license. Hosting without an additional fee does not make that content free. Studio is included with Serakki and is not sold separately. Browser Studio access requires the corresponding entitlement on your account; playing a different Serapack does not, by itself, grant that access. A desktop or store purchase provides eligibility for hosted access only where expressly stated in its offer. Browser access requirements do not remove the Studio entitlement included with a lawfully obtained desktop full-game edition.

The interactive Boards and limited Studio preview on my website are free to use within the functionality offered there as part of the product presentation. Using them does not grant an entitlement to the installed full game, its Studio, paid content or reuse of official assets.

## 2. Accepting this agreement

Read this agreement before registering for a Serakki account or downloading, installing or using the Software. Registration includes an explicit acceptance step linking to this agreement, the Terms of Service and, during the playtest, the Playtest Terms. Account-based downloads are provided after that acceptance. Where a separate acceptance step is provided by an installer, application or authorized store, acceptance occurs through that step. Merely visiting my website or receiving an unsolicited copy does not constitute acceptance.

This agreement is intended to accompany the Software from its first public distribution. It binds you only when supplied and accepted as described above. Publishing it does not retroactively establish acceptance for an earlier download or replace any terms already governing your copy.

If you do not agree, do not proceed with the download, installation or use. If you already purchased the Software, contact the seller about the applicable refund or withdrawal rights; this agreement does not remove those rights. You must have the legal capacity to enter this agreement, or the authorization of your parent or legal guardian where required by law.

## 3. Your license to use the Software

Subject to this agreement and your lawful entitlement, I grant you a limited, non-exclusive license to install and use the Software on computers you own or control for your personal use, the authoring and sharing activities permitted in section 6, and the media uses permitted in section 7. You may make copies reasonably necessary for installation, use and personal backup. These permissions do not authorize making the Software available to other people. Store features expressly permitted by the applicable store terms, and rights that mandatory law grants you, remain available.

For the browser applications, the permission to use the Software applies within the hosted Service and the scope of your relevant entitlement; it does not grant a right to download, self-host or redistribute the Service. Your Studio entitlement permits the authoring features included in your Serakki edition, without granting rights to extract or reuse official Serapack resources. Serakki includes its base world and Mini; additional paid Serapacks or DLC require their own valid entitlements unless expressly included in the applicable offer.

The Software is licensed, not sold. All rights in my code, artwork, music, sound effects, game content, names and other protected materials remain with me or the respective rights holders. No rights are granted beyond those expressly stated here or required by law. Public access to a source repository does not grant a license to build, run or distribute that source; its separate repository license governs those materials.

## 4. Inspection, debugging and decompilation

You may inspect the files and content of your lawfully obtained copy, observe and test its behavior, use debugging tools, and disassemble or decompile it for study, diagnosis or interoperability. You may make temporary analysis copies reasonably necessary for these permitted activities. Attaching a debugger and examining memory are permitted; using those tools to patch the running game, bypass restrictions or unlock content is not, except where mandatory law permits it.

This permission does not authorize creating or running an altered game build, extracting official assets for unrelated reuse, distributing the Software or extracted official protected materials, or publishing a replacement build. You may discuss your findings and report defects, provided you do not redistribute protected code or assets except as legally permitted. Any non-waivable rights to observation, testing, backup, error correction or decompilation remain unaffected.

## 5. Build integrity and distribution

Except for the inspection activities above, supported features below, prior written permission from me, or rights under mandatory law, you must not patch, replace or otherwise modify the distributed executables, application code or bundled official game content, create or use a modified build, or remove copyright and license notices. You must not bypass or disable licensing, entitlement or runtime restrictions, unlock paid content without entitlement, or make Mini run content reserved for the full game.

You must not upload, mirror, host, bundle, sell, rent, sublicense, give away or otherwise redistribute the Software, whether unchanged or modified, including Mini installers, portable archives, updates and paid content. Mini being free does not grant redistribution rights. This restriction does not prohibit your permitted personal backups, authorized store features or transfers that mandatory law requires me to allow.

The official download entry points for Mini are https://serakki.dev and the official Serakki Mini Steam store page. To share Mini, link people to one of these entry points so they receive the applicable legal information. Do not share direct installer or portable-archive links, or a GitHub Releases page as an alternative download entry point, because these bypass the official entry process. Hosting, including GitHub, used by download links on my website is an authorized delivery channel. Obtain the desktop full game from me, through Steam or another distributor expressly authorized by me. Obtaining a copy elsewhere does not establish acceptance or grant permissions beyond this agreement or mandatory law.

## 6. Community Serapacks, your content and supported tools

In this agreement, a Serapack means a playable world distributed as a compiled game directory containing `pack.json` and flat media files, whether authored directly or produced by Build. It does not require a custom archive format.

For authors:

- You may keep your world private or share it only with chosen recipients.
- You must not sell or monetize community Serapacks, their updates or access to them, subject to the exceptions below.
- You decide the sharing, modification and resource-reuse permissions for your own original content.
- Official Serapacks do not grant permission to reuse their assets.

Changing settings, managing saves through supported features, loading compatible community worlds, and creating, editing, building and sharing your own worlds through the Studio are permitted. The build-integrity restrictions concern the distributed applications and bundled official content, not these supported authoring features. The Studio and its documented MCP tools may be operated by you or an agent acting on your behalf within the permissions of your licensed edition.

Official artwork, images, music, sound effects and world configuration are supplied as resources inside the official Serapacks, separately from the application code. Those directories are subject to structural and configuration validation and contain compiled `pack.json` and flat media files, separate from Studio source projects containing `project.json` and typed media directories. This technical layout grants no additional resource-reuse rights. Supported authoring uses your own or separately licensed resources; this agreement does not grant permission to extract or reuse official Serapack resources in a community world or another project. The inspection permission in section 4, independent third-party licenses and mandatory legal rights retain their stated scope.

Every Serapack, regardless of its author, is a playable world package, not an asset or source library. Community Serapacks contain user-created worlds, separate from the official Serakki worlds and DLC. Authors retain the rights they hold in their original content, including their source projects; building or sharing a Serapack does not transfer those rights to me. You are responsible for having the necessary rights to the artwork, audio and other materials you import or share. Sharing a world does not authorize distributing the Serakki application, extracted official assets or a repackaged official world. Players need a lawfully obtained, compatible edition of Serakki to run a Serapack; receiving a package does not grant an application or paid-content entitlement.

Commercial distribution of community Serapacks is prohibited for both authors and redistributors. You must not sell, rent or charge for a package, its updates or access to it. You must not disguise such a charge as a subscription, membership, donation requirement, purchase of another product or service, or a supposedly "free" benefit of a paid offer. Charging for Serapack downloads on a server you operate violates this rule. This restriction concerns community Serapacks, not official Serakki content or DLC distributed by me or an expressly authorized distributor.

Independent fees charged by a third-party distribution platform for its own services do not, by themselves, violate this rule. You may also share a Serapack within an existing paid community or service when its paid offering exists independently of the Serapack and is not a way to charge for the package or access to it. These exceptions do not permit you to create, arrange or control a paid distribution scheme whose purpose is to monetize access to community Serapacks. Make reasonable efforts to respect the package's free distribution within the services you use; you are not required to guarantee a third party's pricing or provide a separate free download elsewhere.

A Serapack does not have to be published or made available to everyone. You may keep it for yourself or share it only with chosen recipients or a closed group. Subject to the prohibition on selling or monetizing community Serapacks or access to them, its author decides who may receive, share, republish or modify their content and under what conditions. A package being free does not, by itself, authorize anyone to republish it. I manage official Serakki content; I do not take ownership of community content or set its author's additional sharing and publication terms.

Receiving or playing a Serapack does not, by itself, grant rights to extract, reuse or redistribute its resources. For community content, those permissions belong to the author or other relevant rights holders: they may permit extraction or reuse and separately license their original resources and source projects. I impose no additional restriction on those permissions beyond the prohibition on selling or monetizing community Serapacks or access to them. Authors cannot grant rights to official assets or other materials they do not own. Independent third-party licenses and mandatory legal rights remain unaffected.

## 7. Screenshots, videos and streams

You may create, edit, publish and livestream screenshots and recordings of gameplay or Studio use, including reviews and tutorials, and monetize them through advertising, sponsorships, subscriptions or viewer support. This permission covers my artwork, music and sound effects as they appear or play within those videos and streams, including on YouTube; you do not need to mute the game's audio. You remain responsible for permissions for separately imported third-party or community content.

This permission does not authorize distributing or reusing extracted or isolated official artwork, music, sound effects or other official protected assets as standalone files, asset packs, soundtrack uploads or materials for unrelated projects. Standalone asset distribution is not permitted merely because the material was captured from the running Software instead of extracted from its files. Any permissions independently granted by community authors, third-party licenses or mandatory law remain unaffected.

## 8. Mini and full-game support

Serakki Mini is provided free of charge in its available form, without voluntary technical support, maintenance commitments or promised future updates. You may send feedback, but doing so does not create a promise that I will reply, investigate or implement a change.

For the full Serakki game, you may request basic help at support@serakki.dev or through the official Discord linked from my website. This voluntary help is offered at my discretion, without a service-level agreement or guarantee of availability, response time, resolution or a particular fix. Discord is not a required channel for exercising legal rights.

After the playtest ends, desktop playtest builds receive no further voluntary technical support, maintenance, fixes or updates. I no longer accept ordinary bug reports, feature requests or voluntary technical-support requests for those builds, and I do not promise compatibility with later software or content. This does not close the contact route for statutory complaints, privacy or legal requests, or security reports at support@serakki.dev.

These limits concern voluntary help only. They do not exclude support, necessary updates, complaint handling, remedies or other obligations required by applicable law or expressly promised at purchase. To exercise statutory rights against me, contact support@serakki.dev. For claims against your seller, including Steam purchase or refund matters, use that seller's applicable process. I cannot treat a statutory complaint as optional feedback.

## 9. Warranties and your statutory rights

Except for express contractual commitments and rights that cannot legally be excluded, the Software is provided "as is" and "as available", without additional contractual warranties. I do not promise that it will be error-free, work with every hardware or software configuration, or remain compatible with unsupported third-party modifications or content. Check the stated system requirements before obtaining it and keep backups of important saves and projects.

Nothing in this agreement excludes or limits mandatory consumer rights, including applicable rights concerning conformity with the purchase description, necessary updates, remedies for defects, refunds or withdrawal. These rights take priority over any conflicting wording here, including the as-is and support clauses. They can also apply to free digital content where the law so provides.

## 10. Liability

Only to the extent applicable law allows, I exclude liability for indirect or consequential losses arising from use of the Software, including loss of profit, business opportunity or data. This clause does not limit liability for death or personal injury, fraud, intentional misconduct, gross negligence, breach of mandatory consumer obligations, or any other liability that cannot lawfully be excluded or limited. Your statutory remedies remain available.

## 11. Stores and third-party licenses

Third-party components and materials retain their own licenses and notices. This agreement does not restrict permissions those licenses independently grant you. That does not grant rights to redistribute the rest of the Software. Community content remains subject to the rights and permissions of its author.

If you obtain the Software through Steam, the Steam Subscriber Agreement and applicable purchase and refund terms also govern your relationship with Valve. This agreement governs the permissions I grant you for the Software and does not authorize conduct prohibited by the store's terms. Store-managed features remain subject to those terms. No clause here overrides mandatory law or reduces rights granted by your purchase contract.

## 12. Duration and changes

This license continues while you comply with this agreement and have a lawful entitlement. You may end it by stopping use and deleting your copies, without giving up rights in your own original content. For a material breach, I may terminate this license by notice, after a reasonable opportunity to remedy a breach that can be remedied, subject to mandatory law. Termination does not remove statutory remedies or authorize me to restrict an unrelated store account.

A hosted-account restriction or the closure of hosted functions does not, by itself, terminate your license to use a lawfully obtained desktop copy, including its licensed content and Studio where included. Any withdrawal, refund or termination affecting that license must have its own applicable contractual or legal basis.

A payment dispute or chargeback decision does not, by itself, terminate this license. Any separate termination remains subject to the applicable grounds and notice requirements in this agreement and law.

Partial refunds and price reductions that leave a purchase in force do not terminate this license. A successful full refund cancelling the affected purchase ends only the permissions granted solely by that purchase, subject to mandatory law and any independent license or other valid purchase. Pending or failed refunds have no such effect.

The version you accepted governs the copy supplied under it. Publishing a revised agreement on my website does not, by itself, replace your existing agreement. Any new terms must be brought to your attention and accepted where required by law; they cannot remove non-waivable rights or retroactively revoke permissions for your existing copy.

## 13. Governing law and disputes

This agreement is governed by the laws of the Czech Republic. If you are a consumer, this choice does not deprive you of mandatory protections available under the law that would otherwise apply, including applicable protections in your country of habitual residence. Disputes may be brought before any court competent under applicable law. This agreement does not require mandatory arbitration or waive access to courts or applicable out-of-court consumer dispute procedures.

For eligible consumer disputes with me arising from a purchase or paid service that remain unresolved after you contact me, you may seek out-of-court resolution through the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI), Gorazdova 1969/24, 120 00 Praha 2, Czechia. Information and the submission process are available at https://coi.gov.cz/informace-o-adr/. For a dispute with a store as the seller, use the process applicable to that seller. This does not affect your right to go to court.

If a provision is unlawful or unenforceable, it applies only to the extent legally permitted or is disregarded as the law requires. The remaining provisions continue to apply only insofar as they can lawfully do so. An invalid restriction does not remove the statutory right it attempted to restrict.
